Article 1 – Definitions

In these Terms and Conditions:

  • Cooling-off period: the period within which the consumer may exercise the right of withdrawal.

  • Consumer: any natural person not acting in the exercise of a profession or business who enters into a distance contract with the entrepreneur, as well as legal persons acting in a professional capacity who also enter into a distance contract.

  • Day: calendar day.

  • Duration transaction: a distance contract relating to a series of products and/or services whose delivery obligations are spread over time.

  • Durable medium: any device that enables the consumer or entrepreneur to store information in a way that allows future reference and unchanged reproduction.

  • Right of withdrawal: the right of the consumer to withdraw from a distance contract within the cooling-off period.

  • Model form: the withdrawal form provided by the entrepreneur that the consumer may use to exercise the right of withdrawal.

  • Entrepreneur: the natural or legal person offering products and/or services at a distance to consumers.

  • Distance contract: a contract concluded between the entrepreneur and the consumer as part of a system organized for distance selling, using one or more remote communication techniques.

  • Remote communication technique: means that can be used to conclude a contract without consumer and entrepreneur being physically present together.

  • Terms and Conditions: these Terms and Conditions of the entrepreneur.


Article 2 – Applicability

These Terms and Conditions apply to every offer made by the entrepreneur and to every distance contract concluded between entrepreneur and consumer.

Before concluding a distance contract, the text of these Terms and Conditions will be made available to the consumer. If this is not reasonably possible, the consumer will be informed how the Terms and Conditions can be inspected at the entrepreneur’s premises and will be sent free of charge upon request.

If the distance contract is concluded electronically, these Terms and Conditions may also be provided electronically in such a way that the consumer can easily store them on a durable medium.

If, in addition to these Terms and Conditions, specific product or service conditions apply, the consumer may always rely on the most favorable provision in the event of conflicting terms.


Article 3 – The Offer

If an offer has a limited validity period or is made subject to conditions, this will be stated explicitly in the offer.

The offer is non-binding. The entrepreneur may change or withdraw the offer.

The offer contains a complete and accurate description of the products and/or services offered. Images are intended to be a truthful representation, but colors and appearances may vary.

Obvious mistakes or errors in the offer do not bind the entrepreneur.


Article 4 – The Agreement

The agreement is concluded at the moment the consumer accepts the offer and meets the stated conditions.

If the consumer accepts the offer electronically, the entrepreneur will immediately confirm receipt of acceptance electronically.

The entrepreneur takes technical and organizational measures to secure electronic data transfer and ensures a safe web environment.

The entrepreneur may investigate whether the consumer can meet payment obligations and may refuse orders with justification.

Each agreement is entered into under the suspensive condition of sufficient product availability.

Important notices:

  • Orders are only available for persons aged 18 or older. By placing an order, you confirm you are at least 18 years of age. Identification may be requested.

  • Products are sold strictly for research purposes only. They are not for human consumption.

  • The buyer is responsible for proper storage and use of the products, keeping them out of reach of children, pets, and persons with reduced judgment capacity.

  • The entrepreneur cannot be held liable for misuse or unintended use of products.


Article 5 – Right of Withdrawal

Consumers have the right to withdraw from a purchase within 14 days without giving any reason. The withdrawal period begins the day after receipt of the product.

During this period, the consumer shall handle the product and packaging with care. If exercising the right of withdrawal, the product must be returned in its original state and packaging.

Withdrawal must be communicated within 14 days, either via the model withdrawal form or another clear statement (e.g., by email). After notification, the consumer must return the product within 14 days.

If deadlines are not met, the purchase becomes final.


Article 6 – Costs in Case of Withdrawal

If the consumer exercises the right of withdrawal, the consumer bears the cost of return shipping.

Refunds will be made as soon as possible, and no later than 14 days after withdrawal, provided the returned product has been received or proof of shipment has been supplied. Refunds will be issued to the same payment method used, unless otherwise agreed.


Article 7 – Exclusion of Right of Withdrawal

The right of withdrawal may be excluded for:

  • Products made to consumer specifications.

  • Products clearly personal in nature.

  • Products that cannot be returned due to their nature.

  • Products that may spoil or age quickly.

  • Sealed products that are not suitable for return for health protection or hygiene reasons once unsealed.

  • Newspapers, magazines, audio or video recordings, or computer software once unsealed.

The entrepreneur must state clearly in the offer if the right of withdrawal is excluded.


Article 8 – Price

Prices include VAT.

During the validity period stated in the offer, prices will not be increased except for changes due to VAT or legal requirements.

Obvious printing or typographical errors are not binding.


Article 9 – Conformity and Warranty

The entrepreneur guarantees that products and/or services comply with the contract, specifications, and reasonable standards of quality.

Legal warranty applies to all products. Warranty may be void if products have been repaired, modified, or improperly used.


Article 10 – Delivery and Execution

The entrepreneur will take the greatest care in processing orders.

Delivery will be made to the address provided by the consumer. Orders will be executed promptly, within 30 days unless a longer period is agreed.

Risk of loss or damage passes to the consumer upon delivery.


Article 11 – Duration Transactions: Term, Termination, Renewal

Consumers may terminate contracts of indefinite duration with a maximum one-month notice.

Fixed-term contracts cannot be automatically extended beyond the agreed period, except for specific subscriptions under Dutch law.


Article 12 – Payment

Unless otherwise agreed, payments must be made within 7 business days after the start of the withdrawal period.

The consumer is obliged to report inaccuracies in payment details.


Article 13 – Complaints Procedure

Complaints must be submitted clearly within 2 months after discovery of a defect.

Complaints will be answered within 14 days of receipt. If more time is needed, the consumer will be informed when to expect a substantive response.

If a complaint cannot be resolved, a dispute may be submitted under Dutch law.


Article 14 – Disputes

All agreements between entrepreneur and consumer are governed exclusively by Dutch law.

The Vienna Sales Convention does not apply.

Article 16 – Additional or Deviating Provisions

Additional provisions may not be detrimental to the consumer and must be recorded in writing or in a durable medium accessible to the consumer.
